After your appeal is registered, the local authority (LA) must send its formal response to the tribunal. This explains their position, why they made their decision and includes any evidence they are relying on.
You will then have the opportunity to:
- send further submissions (additional comments or evidence)
- prepare a position statement later in the process, this will summarise what has been agreed and what is still in dispute
The tribunal uses these documents to understand the key issues before the hearing. It helps everyone focus on what needs to be decided, as well as providing everyone with a clear understanding of the arguments to be presented by each party as well as any developments.
What may happen — step-by-step
LA response
- the LA must send its official response within 30 days of your appeal being registered
- you will receive a copy automatically
- it should include their explanations, evidence and any professional reports they rely on

You can send additional information after reading the LA’s response.
This might include:

Position statement
This is a short written document prepared before the hearing. It explains each parties final position and highlights what is still in dispute. This helps the judge and panel focus on the remaining key issues.
It should include
- what the appeal is about

- what each party is asking the tribunal to decide
